Warranty

At the time of transfer of risk, we, ToniSport GmbH, guarantee that the delivered products are free of material defects and defects of title in accordance with Sections 434 and 435 of the German Civil Code (BGB).

In the event of a defect, you as a consumer are entitled, in accordance with Section 439 of the German Civil Code (BGB), to choose between rectification of the defect or delivery of a defect-free item, as well as a reduction in the purchase price or withdrawal from the purchase contract, provided that the defect is not insignificant. In accordance with Section 439 of the German Civil Code (BGB), we are entitled to refuse the type of subsequent performance chosen by the buyer if it is only possible at disproportionate cost. If a defect-free item is delivered for the purpose of subsequent performance, we are entitled to demand the return of the defective item.

If the defect cannot be remedied within the scope of a repair even after a second attempt, you are entitled under Section 439 of the German Civil Code (BGB) to demand the delivery of a defect-free item, to reduce the purchase price or to withdraw from the contract. Withdrawal is excluded if the defect is minor and insignificant.

Warranty period

The warranty period is two years and begins upon receipt of the goods. Warranty claims are subject to the condition that the defect was not caused by improper use or overuse. If a defect becomes apparent more than six months after delivery, you must provide evidence that the item was already defective at the time of transfer of risk. Otherwise, we are free to prove that the item did not have any material defects at the time of delivery.

Guarantee

Regardless of the warranty, the guarantee provided by the manufacturer applies. For details, please refer to the enclosed guarantee terms and conditions.

Damages

With regard to any claims for damages due to defects in the goods, the statutory provisions apply, in particular Sections 280ff, 311a and 823 of the German Civil Code (BGB).
